DORU CATALIN BOSTINA

Member of the Bucharest Bar Association since 2004.

Doru Catalin Bostina is an expert in business law. He was a legal consultant for several major Romanian investment projects and supervised legal matters related to many energy, oil and gas deals. In his position as the Managing Partner of “Bostina & Associates” Law firm he was deeply involved in coordinating the most important projects in which the Firm took part.

Doru Catalin Bostina is a member of the Bucharest Bar Association since 1992 A graduate of Bucharest Law Faculty, he also attended the French – Romanian Institute of Business Administration becoming an expert in Business Administration and Financial Management.

Between 1999 and 2000 he was the legal adviser of the Romanian Finance Minister, a position that gave him the chance to have an insight view of the complex matters of fiscal administration.

He took part in major bank syndication and international financing projects generally carried out including by international financial bodies and counts among his achievements successful projects in banking retail ranging from assistance provided for launching new banking products and services to the implementation of central bank’s set of rules concerning risk management in this area.

In addition to the foregoing, he has relevant expertise in adjacent areas such as procurement and mergers which is not confined to procurement on the banking market but also regards the financing component of such procurement projects and mergers carried out by various companies

Cristian Costea has actively participated in the development of many projects for the procurement and implementation of integrated information systems intended for the management of internal activities within public authorities and institutions from Romania, of the integrated system project for the security of Romania’s state frontier - SISF carried out by the Ministry of Administration and Internal Affairs and of the project initiated by the Romanian Government with a view to purchasing Microsoft licences for all the public authorities and institutions in Romania.

He has a rich experience in setting up various forms of partnerships (PPPs, joint – ventures, concessions etc.), obtaining external financing intended for the modernization or development of various infrastructure objectives in the area of transport (airports, railways etc.), but also in carrying out setoffs as a result of procurement of special technique equipment destined to the national defence and security.

Ovidiu has vast experience in the insurance/reinsurance area as well as solid knowledge in the legislation of private pensions funds. Ovidiu Tibuleac has also granted legal consultancy and assistance in various specialized areas (commercial law, financial and tax law, civil law) in drafting petitions, legal actions, agreements, legal opinions and other legal deeds or legislative acts drafts in such areas incidental or collateral to insurance.

Ovidiu has been constantly present in TV broadcasts, especially in the “Insurance Policy” broadcast by the “The Money Channel”.

Before joining “Bostina & Associates” team of lawyers, Ovidiu was the manager of the Legal Department of the Insurance Supervisory Commission and of the “Guarantee Fund” Department of such authority, within which he actively participated in preparing legislative acts drafts regulating the insurance and reinsurance areas in Romania.

LAURA MOCANU

Laura Mocanu has special knowledge in international, commercial, civil, administrative and procedural-civil law.

She has rich experience in developing the strategy for the participation in the privatization procedures, in drafting and/or analyzing any deeds/documents of legal nature required with a view to participating in the privatization process, assistance and representation before the public institutions involved in accomplishing the privatization process (Authority for State Assets Recovery, Ministry of Economy and Finance, Competition Council, other ministries and public institutions concerned, etc.), consultancy in respect of the most varied aspects relating to carrying out the privatization process (the social issue, the issue of outstanding budget and commercial debts of companies that are privatized, etc.) post-privatization, legal assistance, consultancy and representation including in the „privatization by liquidation” procedures (sale-purchase of goods/assets of companies subject to voluntary liquidation or bankruptcy).

ROXANA ARGHIROIU

Roxana has vast experience in granting legal assistance and representation throughout the period during which clients are subject to tax inspections, as well as in administrative litigations and tax procedural law, representing clients before the bodies which have the capacity to settle tax disputes, namely specialised bodies within the National Agency for Tax Administration and the competent law courts.

Her experience in tax law was acquired through activities such as drafting legal opinions in respect of how to interpret and apply internal tax legislation concerning the value added tax, excise duties, profits tax, income tax for non-residents, etc., as well as the Treatises for Avoidance of Double Taxation concluded by Romania with other states.

Roxana was part of the team of consultants that participated in the discussions on the elaboration of the Tax Code and the Tax Procedural Code, as well as on the amendment and supplementation thereof.

Ovidiu has vast experience predominantly in the areas of intellectual property and mass media, in which he has specialized through persistent practice. He is a Patent Attorney also certified for European practice by the Romanian State Office for Inventions and Trademarks, a member of the Patent Chamber since 2004, being acquainted with the performance of all procedures in connection with the registration of any types of industrial property rights. He is among the first consultants in Romania to have put into practice the specific procedures for the protection of industrial property rights within customs clearance operations.

Ovidiu has rich experience accumulated in the legal assistance granted to clients in disputes whose objects are industrial property rights. He also has rich experience in the copyright domain, granting legal assistance and representation to clients in the relation with Collective Management Bodies and ORDA [Romanian Copyright Office].

In the domain of media, Ovidiu has granted legal consultancy and assistance to the company’s clients, particularly in the relation with the National Audio-Visual Council, as well as in the relations between various media institutions.

Before joining Bostina & Associates, Catalin was a manager within the National Regulatory Authority for Public Services, participating in drafting the enactments by which public services organisation and operation are regulated, being involved in projects on public corporations reorganisation, regionalisation and concession of public services.

He also participated in finalising the internal regulations and correlation thereof with international financial institutions requirements in view of implementation of financing programmes for public services infrastructure development, coordinated and participated in drafting due diligence reports on public services organisation and operation.

In 2005 Catalin Giscan was a Lecturer delivering the post-graduate course “Business Management in Public Administration” organised by Academy of Economic Studies, teaching administrative law and its implications for public services and transposition of the community acquis in public services.

Alex graduated from post-graduate studies in “Forensic Sciences and Criminology” organized by the Faculty of Law, University of Bucharest, and in “Mediation and Other Dispute Resolution Techniques” – organized by the American Bar Association and the Ombudsman Institution and graduated from the “Project Management” course – organized by CODECS and The Open University.

MARINA TOPSA
