Bostina & Associates obtained the release of Metro Cash & Carry Romania from the insolvency procedure

The judgment passed on 20th of November 2008 is irrevocable. Bucharest Court of Appeal admitted the second appeal filed by Bostina & Associates Lawyers on behalf of Metro Cash & Carry Romania against the commercial decision no. 2278/16 May 2008 whereby Bucharest Court of Law allowed the insolvency procedures.

 

Bucharest Court of Appeal dismissed the petition for suspension based on the fact that it lacked its object, fully amended the challenged decision, to the effect that it admitted the opposition of the debtor, dismissed the petition of the creditor and ordered the submission of the file to the same court that initiated the procedure in order to close the procedure.

 

Bostina & Associates previously obtained the temporary suspension of the decision for opening the insolvency procedures on 5th of June 2008, a procedure that had been initiated by Bucharest Court of Law on 16 May 2008 for a receivable of approximately EUR 50,000 claimed by Toneli Holding.
